1. Acceptance

By accessing or using Urban Sketch Trails, users agree to these Terms of Service, the Privacy Policy, community rules, submission rules, and any other policies incorporated by reference. Users must accept these terms before creating or uploading user-generated content. If a user does not agree, that user must not use the service.

2. Eligibility

Users represent that they are legally capable of entering into a binding agreement. If the service is used by minors, parental or guardian involvement may be required where applicable by law.

3. Service description

Urban Sketch Trails provides city trail discovery, location information, community contributions, maps, weather-linked suggestions, business listings, and related digital services. Features may change, be suspended, or be discontinued at any time without liability to the fullest extent permitted by law.

4. Account security

Users are responsible for maintaining the confidentiality of their credentials and for activity occurring through their accounts except to the extent caused by the platform's own failure. Urban Sketch Trails may suspend or terminate accounts suspected of abuse, infringement, fraud, unsafe behavior, or policy violation.

5. Acceptable use

Users must not:

• Upload content they do not own or have rights to use.
• Copy, scrape, republish, frame, mirror, reverse engineer, or exploit the service except as permitted by law or written consent.
• Infringe copyright, trademark, privacy, publicity, database, moral, or other rights.
• Upload malware, spam, scams, deceptive content, or unlawful material.
• Harass, impersonate, threaten, defame, dox, stalk, or exploit others.
• Interfere with the platform, its security, moderators, vendors, or users.
• Use bots or automation to mass-submit content, harvest data, or manipulate rankings.

6. User-generated content and contributor warranties

When users submit sketches, photos, stories, comments, edits, or other content, they represent and warrant that:

• they own the content or have all necessary rights, permissions, consents, and licenses to submit it;
• the content does not infringe any copyright, trademark, patent, trade secret, privacy, publicity, contractual, or other right;
• the content is not unlawful, defamatory, misleading, abusive, obscene, harmful, or otherwise prohibited;
• any people depicted have consent where required; and
• any third-party material is clearly disclosed and authorized.

7. License granted to Urban Sketch Trails

By submitting content, the user grants Urban Sketch Trails a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, cache, reproduce, adapt for formatting, crop, resize, translate, transcode, display, distribute, publish, publicly communicate, moderate, remove, archive, and otherwise use the content for operating, improving, promoting, securing, and administering the service. This license continues for as long as reasonably necessary to operate the service, maintain historical trail continuity, preserve moderation records, resolve disputes, comply with legal obligations, enforce agreements, or retain backups and archives.

8. Moderation and enforcement

Urban Sketch Trails may, but is not obliged to, monitor, review, pre-screen, remove, restrict, demonetize, down-rank, annotate, or investigate any content, account, or activity. Urban Sketch Trails may take action without prior notice where reasonably necessary for safety, legal compliance, IP protection, policy enforcement, technical integrity, or business interests.

9. Reports, complaints, and takedowns

Urban Sketch Trails may provide mechanisms to report infringing, unlawful, unsafe, or otherwise objectionable content. The platform may request additional information, temporarily restrict content, contact the uploader, preserve evidence, or remove the content pending investigation. Submitting a knowingly false complaint or fraudulent notice may itself be a policy violation and may expose the complainant to liability where allowed by law.

10. Platform content and ownership

Except for user-generated content and third-party materials, the service, including software, branding, text, layout, design, databases, trail structures, original illustrations, icons, and other platform materials, is owned by or licensed to Urban Sketch Trails and protected by applicable intellectual property laws. No right, title, or interest is transferred except for the limited right to use the service under these Terms.

11. Trademarks and branding

All names, logos, slogans, and trade dress used by Urban Sketch Trails are claimed as proprietary to the extent permitted by law unless otherwise stated. Users may not use platform branding, logos, or confusingly similar marks without prior written permission.

12. Third-party services and content

The service may rely on third-party maps, weather feeds, payment providers, analytics providers, business listings, social features, and external links. Urban Sketch Trails is not responsible for third-party content, terms, availability, accuracy, or acts and omissions, and users access those services at their own risk subject to the relevant third-party terms.

13. No professional, legal, travel, or safety advice

Urban Sketch Trails content is for general information and exploration purposes only. Trail conditions, weather, accessibility, business hours, safety conditions, local rules, and location details may change, so users remain responsible for independent judgment, local compliance, and personal safety.

14. Assumption of risk for physical exploration

Using trail suggestions, walking routes, location prompts, weather-linked recommendations, or nearby place suggestions may involve travel, movement, crowds, terrain, traffic, weather, or other real-world risks. Users voluntarily assume these risks and should obey local law, use common sense, and stop using a route or feature if conditions are unsafe.

15. Disclaimer of warranties

To the fullest extent permitted by law, the service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, quiet enjoyment, or error-free operation.

16. Limitation of liability

To the fullest extent permitted by law, Urban Sketch Trails, its owner, affiliates, licensors, contractors, moderators, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages, or for loss of profits, data, goodwill, reputation, use, business interruption, personal injury, property damage, or legal claims arising from or relating to the service, user content, third-party content, moderation decisions, route suggestions, weather information, business listings, security incidents, or unauthorized access.

If liability cannot be excluded, the total aggregate liability of Urban Sketch Trails shall be limited to the greater of: (a) the amount paid by the user to Urban Sketch Trails in the 12 months before the claim, or (b) INR 1,000, to the extent permitted by law.

17. Indemnity

Users agree to defend, indemnify, and hold harmless Urban Sketch Trails, its owner, affiliates, moderators, contractors, and service providers from and against all claims, demands, actions, proceedings, losses, damages, liabilities, penalties, costs, and expenses, including reasonable attorneys' fees and professional fees, arising out of or related to:

• the user's content;
• infringement or alleged infringement of any right by the user;
• the user's breach of these Terms or any policy;
• the user's misuse of the service; or
• the user's violation of law or rights of any person.

18. Suspension and termination

Urban Sketch Trails may suspend, restrict, delete, or terminate accounts, content, access, benefits, or features at any time with or without notice where reasonably required for legal, operational, security, moderation, business, or policy reasons. On termination, provisions that by nature should survive will survive, including ownership, licenses, disclaimers, indemnity, liability limits, dispute clauses, and record-retention rights.

19. Reservation of rights

Urban Sketch Trails reserves all rights not expressly granted. Failure to enforce any provision is not a waiver.

20. Governing law and dispute resolution

These Terms shall be governed by the laws of India, without regard to conflict-of-law rules, unless mandatory law requires otherwise. Courts at Pune, India shall have exclusive jurisdiction, provided Urban Sketch Trails may seek interim, injunctive, or equitable relief in any competent court to protect intellectual property, confidential information, platform integrity, or user safety.

Optional arbitration clause: Any dispute arising out of or relating to these Terms may first be attempted to be resolved amicably within 30 days, failing which it may be referred to arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by Urban Sketch Trails, with seat and venue at Pune, and proceedings in English.

21. Force majeure

Urban Sketch Trails is not liable for delay or failure caused by events beyond reasonable control, including natural disasters, internet failures, war, terrorism, civil unrest, labor disputes, pandemics, power failure, vendor outage, cyberattacks, governmental action, or legal restrictions.

22. Changes to the service or terms

Urban Sketch Trails may modify the service, prices, features, policies, or these Terms from time to time. Changes may take effect on posting or on a stated date, and continued use after that date will constitute acceptance to the extent permitted by law.

23. Severability and entire agreement

If any provision is found unenforceable, the remaining provisions remain in effect to the fullest extent possible. These Terms, together with incorporated policies, form the entire agreement between the user and Urban Sketch Trails regarding the service.
